दिल्ली में महिलयों की विस्थापन के विरुद्ध बहादुराना संघर्ष की रिपोर्टः प्रगतिशील महिल संगठन द्वारा

        गोसिया काॅलोनी, महरौली स्थित 1100 परिवारों के आशियाने उजाड़े जाने व उनके संघर्ष पर पुलिस दमन के सदंर्भ में जांच रिर्पोट।

9 मई, 2013 की रात लगभग 12 बजे प्रमस के साथियों को कुछ महिलाओं द्वारा जानकारी हुई कि चाणक्यपुरी पुलिस थाने के अन्दर लगभग 50 महिलाओं को बंद रखा गया है तथा उनके पास गोदियां बच्चे भी हैं तथा पुलिस उनसे बेहद बदसलूकी कर रही है। प्रमस महासचिव ने तुरन्त एसएचओ चाणक्यपुरी को फोन किया तो जानकारी हुई कि लगभग 16 महिलाओं को 188 आईपीसी के तहत केस बनाकर कोर्ट में पेश किया गया था तथा लगभग 40 महिलाओं को निजि मुचल्कै पर छोड़ा गया है और क्योंकि बोन्ड भरने में समय लगा इसलिए इतनी रात हो गई। उन्होनें स्पष्ट नहीं बताया कि महिलाऐं कौन हैं। 10 मई, 2013 को रात लगभग 11.45 बजे महिलाओं ने फिर फोन करके कहा कि उनके साथ पुलिस दुव्र्यवहार कर रही है जबकि वे अहमद पटेल से मिलने जा रही हैं। एसएचओ चाणक्यपुरी से प्रमस महासचिव ने बात की तो पता लगा कि अभी वे कर्बला के पास हैं और रोज रात को प्रदर्शन करती हैं। 11 मई की रात 12.00 बजे एक पीडि़त महिला ने प्रमस महासचिव को फोन कर बताया कि चाणक्यपुरी पुलिस लगभग 50 महिलाओं को ग्यारह मूर्ति पर रोक कर महिलाओं पर मार-पिट, गाली-गलौच कर रही है। एक महिला की हाथ की उंगली टूट गई है। महिलाओं और छोटे बच्चों को चोट आई हैं। प्रमस महासचिव ने पहले 100 नम्बर पर रिर्पोट दर्ज करवाई तथा फिर क्षेत्र के डीसीपी, एसबीएस त्यागी से फोन पर बातचीत की। उन्होनें कहा कि यें औरतें भाड़े की है। रोज सुप्रीम कोर्ट के आदेश का उल्लघंन करती है। पिछले 26 दिन से रोज आती है जब उनसे पूछा गया कि अहमद पटेल से आप उनको मिलवा क्यों नहीं देते तो उनका कहना था कि इसमें हम कुछ नहीं कर सकते।
        पुलिस के इस बर्बर रवैये तथा महिलाओं के चाणक्यपुरी थाना क्षेत्र में उन पर पिछले कई दिनों से हो रही हिंसा के कारणों की विस्तारपूर्वक जांच के लिए प्रमस ने इलाके में जाकर पूरे घटनाक्रम की जानकारी का निर्णय लिया।
        दिनांक 14.05.2013 को शाम 4.00 बजे अंधेरिया मोड़ स्थित गोसिया काॅलोनी में जांच दल ने पाया कि लगभग 500 परिवार जो सभी मुस्लिम है, प्लास्टिक सीट तथा कच्चे टैन्ट डालकर रह रहे है। स्थानीय महिलाओं ने हमें बताया कि 5 दिसम्बर, 2012 तक यहां लगभग 1100 परिवार (सभी मुस्लमान) पक्के घर बनाकर रहते थे तथा गोसिया काॅलोनी खसरा नम्बर 217 तथा 1153/3 में बसी हुई है। तथा 5 दिसम्बर, 2012 को उनके घर डीडीए के बुलडोजर ने गिरा दिए। बहुत से मजारों को क्षति पहुंची तथा गोसिया मस्जिद की ताजा बाउंड्री दरवाजा, वजूहखाने का उखड़ना सब साफ था। पुराना गेट भी मस्जिद के एक तरफ रखा गया था। इलाका वासियों ने नूरी मस्जिद की जो चारदीवारी बिल्कुल तोड़ दी थी वो भी दिखाई, मामा भान्जा की मजार, ऐतिहासिक स्मारक दिखाऐ। इलाके के वासियों ने वक्फ बोर्ड द्वारा जारी रसीदें दिखाई जो कि कुछ वर्ष पुरानी थी। अपने वोटर आई-कार्ड भी दिखाऐ जिनमें कुछ वासियों ने बताया कि उनके परिवार के लोग दुबई में नौकरी करने गए है तथा उनका पासपोर्ट गोसिया काॅलोनी के पते पर जारी किया गया है। पिछले 6 महिने से भारी सर्दी, ओलें और बरसात में, नन्हे बच्चे, बुजुर्गवार ने पतले प्लास्टिक टैन्ट में बेहद मुश्किलों में समय गुजारा। उन्होनें दावा किया कम से कम 10 मौतें ठंड के कारण हो गई। इलाके में रह रहे लोगों को शौचादि जाने की कोई उचित व्यवस्था नहीं है। महिलाओं व लड़कियों को विशेष परेशानी का सामना करना पड़ता है। छेड़खानी, तानाकशी जो कि डीडीए के पार्क में आने वालों द्वारा की जाती है जबकि वे नित्य क्रिया के लिए वहां जाती है। पिछले तीन-चार दिन से पुलिस इलाके को घेर रही है तथा महिलाओं को इलाके से बाहर निकलते समय उनका बुरका उतारकर देख रही है तथा कहीं बाहर जाने से रोक रही है। पढ़ने वाले छात्रों की पढ़ाई का भारी नुकसान हुआ है। मकान ढहा दिये जाने के समय लोगों को अपना सामान निकालने का मौका तक नहीं दिया गया। जिसके कारण विद्यार्थियों के बस्ते, किताबें सब मलबे में दब कर नष्ट हो गए। मकान तोड़ दिये जाने के बाद इलाका वासियों ने शहरी विकास मंत्री श्री कमल नाथ के पास धरना दिया क्योंकि डीडीए ने डमोलिशन की थी। कई बार धरना देने के बाद कांग्रेस अध्यक्ष श्रीमती सोनिया गांधी से दिनांक 26.02.2013 को शाम 6.00 बजे 24 अकबर रोड़ में स्थानीय वासियों सहित महमूद प्राचा (एडवोकेट), अब्बास नकवी, दो इमाम वाला एक प्रतिनिधि मंडल मिला। प्रतिनिधिमंडल से बाचचीत करते हुए सोनिया गांधी ने अपने राजनैतिक सलाहकार श्री अहमद पटेल को पूरे मशले की जानकारी देने के लिए नियुक्त किया।
        महिलाओं का कहना है कि श्री अहमद पटेल ने प्रतिनिधिमंडल को अशवस्थ किया कि वे शीघ्र ही मामले में जांच करेगें। निवासियों ने लगभग एक महिने तक जांच रिर्पोट का इन्तजार किया। महिलाओं ने यह भी बताया कि दिनांक 26.04.2013 को पुलिस गोसिया काॅलोनी स्थित नुरी मस्जिद में घुसी और नमाज अदा कर रहे लोगों को गिरफतार कर लिया। मस्जिद के पास खड़ी महिलाओं को बाल पकड़कर खिंचा। 7 लोगों के खिलाफ महरौली थाने में केस दर्ज किया गया जिसमें दो महिलाऐं भी हैं। 6 पुरूष अभी भी तिहाड जेल में है। महिला निवासीयेां का कहना है कि ये सब प्रयास नुरी मस्जिद तथा इलाके में स्थित सभी पुराने ढांचों के सबुत मिटाऐ जाने के लिए हैं ताकि भू-माफिया, राजनैतिज्ञ, पुलिस तथा वक्फ बोर्ड के सहयोग से जमीन हासिल कर सकें।
दिनांक 26.04.2013 की घटना के बाद लगभग एक सप्ताह तक प्रतिदिन 12 से 5 बजे तक इलाका वासी श्री अहमद पटेल से मिलने जाते और जब वे नहीं मिलते तो उनके निवास/कार्यालय के अधिकारियों ने बताया कि श्री पटेल तो रात के 10 बजे के बाद ही मिलेंगें। अब इलाकावासियों ने मजबूर होकर रात में आना शुरू किया। परन्तु श्री अहमद पटेल उन्हें नहीं मिले और अब औरतेें या उनके प्रतिनिधिमंडल को पुलिस अहमद पटेल के घर के पास पहुंचने ही नहीं देती और यह जानते हुए कि महिलाऐं बेहद गरीब तथा साधन हीन है और बिना किसी शक्तिशाली लोगों की पहचान के हैं। पुलिस ने उनके उपर बर्बर दमन शुरू किया जो कि लगातार बढ़ता जा रहा है। यह नहीं हो सकता कि श्री अहमद पटेल को इन घटनाओं की जानकारी ना हो परन्तु उन्होनें इन लोगों से सम्पर्क करने का अथवा इनके प्रतिनिधिमंडल से मिलने/ सम्पर्क करने का कोई प्रयास नहीं किया। और यदि उन्होनें कोई जांच रिर्पोट बना दी तो कम से कम इन प्रदर्शनकारियों को वे सूचित तो कर सकते हैं। अतैव पिछले कई रातों से जब लगभग 40-50 महिलाऐं (बारी-बारी से) श्री अहमद पटेल के घर के आस-पास पहुंचती तो चाणक्यपुरी पुलिस ही उन्हे मिलती। उन्हे लगभग पुरी रात चाणक्यपुरी थाने में दिनांक 08.05.2013 को रखा गया और 09 मई को 16 औरतों को कोर्ट में पेश किया गया। महिलाओं ने बताया कि उनकी गोद से बच्चे छिन लिए गए और पुलिस ने बच्चों की माओं को कुछ कागज पर साईन करने को कहा तथा उनसे यह भी जबरन वादा लिया गया कि पुलिस द्वारा पिटाई करने की बात वें जज को नहीं बताऐगी। महिला पुलिसकर्मीयों ने उनकी चुडी तोड़ दी और महिलाओं को नौंचा। जांच टीम को चोटों तथा नौचनें के निशान दिखाऐ गए। महिला पुलिस ने महिलाओं की छाती भी दबा दी। मर्द पुलिसवालों ने उनको गन्दी गालियां दी तथा उन्हें जलील किया और महिलाओं के अनुसार उनको धमकी भी दी कि अभी तो जेवर उतरवाये हैं बाद में तुम्हारे कपड़े भी उतरवायेेगें। 12 मई की रात को भी महिलाओं की पिटाई की गई जिसमें महिलाओं को चोट आई। 16 मई, 2013 को एक ही परिवार की दो महिलाओं तथा एक आदमी को महरौली पुलिस ने उठा लिया तथा देर रात तक भी वें नहीं लौटी थी। दुसरी औरत जो नौकरी के लिए साक्षताकार देने जा रही थी उसे भी पुलिस ने पकड लिया और देर रात तक नहीं छोड़ा था। महिलाऐं कहती हैं कि उन्हें पुलिस दुसरे थानों में लेकर जाती हैं तथा उनपर गोसिया काॅलोनी छोड़ देने का दबाव बनाती है।
दस्तावेजों के अवलोकन, निवासियों से हमारी बातचीत के बाद प्रमस टीम इस नतीजे पर पहुंची है कि:-
1.    पुरा क्षेत्र धरोहर क्षेत्र है।
2.    क्षेत्र की ऐतिहासिकता सभी प्रकार के भू-माफिया जिसमें सरकार तथा वक्फ बोर्ड के लोग भी शामिल हैं से पुरी तरह खतरे में है। गोसिया काॅलोनी खसरा नम्बर 217 तथा खसरा नम्बर 1151/3 पर स्थित है। पहला खसरा डीडीए ने 1974 के एक कोर्ट अवार्ड से अधिग्रहण किया था। दुसरा खसरा वक्फ जमीन पर हैं। 2009 में हुई एक सैल डीड हमें दिखाई गई जिससे पता लगा कि इस खसरे नम्बर की जमीन ओलिया मस्जिद की रहने वाली शबनम नामक महिला ने गाजियाबाद की बेबी तथा दिल्ली की श्रीराम काॅलोनी की फर्जाना को लगभग 4 करोड़ से भी अधिक में बेच दिया है। 8 अक्टूबर, 2009 को चार करोड़ सत्तर लाख में बेची गई लगभग 8000 वर्ग गज की जमीन अधिकारिक पंजीकरण द्वारा बेच दी गई है जिसमें 1808000/- रूप्ये की स्टाॅम्प डयूटी जमा की गई है। शबनम विक्रयकर्ता इसी गोसिया काॅलेानी की रहने वाली है जबकि इलाके के सभी घर तोड़ दिये है उसका घर ज्यों का त्यों है। इलाके की कुछ ओर चर्चा भी जरूरी है। गोसिया काॅलोनी की कुछ दूर पर समस तालाब है जिसके उत्तर में एक बुर्ज है। लोगों ने बताया कि दक्षिण की तरफ भी जंगल का इलाका था जो कि अब गायब हो गया है। उनका कहना है कि इस जंगल को एक लाला जसदेव राज ने हटवा दिया जिनका इसी क्षेत्र में नया घर बना हुआ है। गोसिया काॅलोनी के अन्दर ही नुरी मस्जिद तथा एक हाॅज है जो कि प्राचीन इमारत है। खसरा नम्बर 217 जिसमें मजार तथा मस्जिदें है जो कि राष्ट्रपत्र अधिसूचना 10.07.1980 का एक हिस्सा है। (मुस्लीम मजार मस्जिदों के साथ, दरगाह और हूजरा खसरा नम्बर 217)।
3.    जांच दल श्री मतीन अहमद दिल्ली वक्फ बोर्ड के चैयरमैन से भी 16 मई, 2013 को दोपहर में मिला। उन्होनें बताया कि खसरा नम्बर 217 जिसपर गोसिया काॅलोनी बसी है डीडीए ने 1974 एक कोर्ट अवार्ड से अधिग्रहित कर लिया था। वक्फ बोर्ड ने श्रीकमल नाथ शहरी विकास मंत्री को सम्पर्क किया है तथा क्षेत्र को डीनोटिफाई करने की प्रक्रिया लगभग पुरी कर ली है। दुसरी तरफ यह मना करते हुए कि गोसिया काॅलोनी में रहने वाले वक्फ के किरायेदार हैं। उन्होनें बताया कि जब जमीन हमारी है ही नही ंतो ना हमनें इन्हे रहने को कहा ना ही हम उन्हे हटने को कह रहे है। वो इन्कार करते है कि लोगों को कोई रसीद नहीं दी गई है और कहते हैं कि वो किरायेदार आवेदन पत्र दिखा रहे है। खसरा नम्बर 1151/3 के बारे में वो कहते है कि ये वक्फ बोर्ड की जमीन है। जब उन्हें सैल डीड की कापी दिखाई गई तो वो कहते हैं कि ये गैर कानूनी है। खैर कोई अभी तक कब्जा लेने नहीं आया है जब कोई आऐगा हम मामले मेें दखल करेगें।
टीम की टिप्पणियां:-
यह स्पष्ट है कि सघंर्ष करती महिलाऐं अपने परिवारों व अन्य परिवारों के साथ गोसिया काॅलोनी में कम से कम दो दसकों से रह रही हैं।  अगर वोटर आई कार्ड की दिनांक से जाना जाये। इस इलाके की ऐतिहासिक कीमत क्येांकि पूरे इलाके में कब्रिस्तान, मजार व मस्जिद फैली हुई है।  खसरा नम्बर 217 डीडीए की जमीन है- सरकार को कोई अधिकार नहीं है कि वो अचानक रहने वालों के घर तोड़े और लोगों को निस्तापित करें। हालांकि निवासियों की तरफ से लैफिटनैन्ट गर्वनर के दफतर व शहरी विकास मंत्रालय पर दरखास्त दी गई है लेकिन किसी को इन लोगों की कोई परवाह नहीं है। सरकार, डीडीए, वक्फ बोर्ड सब खुश ही कि यह जमीन खाली कर दी गई है।
खसरा नम्बर 1151/3 की कहानी अजीब है। एक सैल डीड दिखाती है कि एक इलाके की रहने वाली महिला ने इस पूरे खसरे को करोड़ों रूप्ये लेकर दो बाहरी महिलाओं को बेच दिया। खसरा वक्फ बोर्ड का था पर इसके चैयरमैन इस बिक्रि पर बिल्कुल परेशान नहीं है। वो कहते है कि अगर कोई इस जमीन को कब्जा करने आए तब हम सवाल को देखेगें।  सवाल ये है कि क्या ये खसरा असल में वक्फ बोर्ड का था ? सवाल ये भी है कि बेचने वाली महिला कौन है ? जब हमने शबनम के घर की तस्वीर लेने की चेष्टा की तो घर के अन्दर से कई लोग निकलकर आऐ जो हमारे साथ बहस करने लगे और हमें चले जाने को कहा। शबनम    कौन है और वक्फ बोर्ड क्यों बिक्रि के बारे में परेशान नहीं है?
यह स्पष्ट है कि केाई बडा भू-माफिया रैकेट है जिसकी नजर में गोसिया काॅलोनी के निवासी एक बडी किरकरी है और सभी इनसे ये इलाका खाली करा देना चाहते है। गोसिया काॅलोनी के निवासियों को आरोप है कि उन्हें किसी भू-माफिया जिसको शक्तिशाली राजनैतिज्ञों का संरक्षण प्राप्त है के इसारे पर ही उजाडा जा रहा है इसलिए पुलिस उन पर दमन कर रही है ताकि उनका सघंर्ष खत्म किया जा सके तथा उन पर इलाका छोडने का चैतरफा दबाव बनाया जा रहा है जैसा कि बहुत से परिवारों ने मजबुर होकर इलाका छोड़ कहीं ओर बसने का निर्णय किया है। दूसरी तरफ पुलिस दावा करती है कि गरीब निवासी भू-माफिया के इशारे पर आते हैं परन्तु पुलिस भू-माफिया की पहचान नहीं कर रही है। वक्फ बोर्ड के चैयरमैन सहमत है कि खसरा नम्बर 1151/3 वक्फ की जमीन है परन्तु उन्हें कोई फर्क नहीं पड़ा कि डीडीए द्वारा इलाके में बुलडोजर चला देने से। केन्द्रीय सरकार अचानक से बेघर कर दिए गए 1100 परिवारों के लिए कुछ नही कर रही । यह भी आश्चर्यजनक है कि करीब एक महिने से जबकि श्री अहमद पटेल के यहां लगातार पदर्शन कर रहे हैं। उन्होनें निवासियों की किसी प्रतिनिधिमंडल से ना तो कोई मुलाकात की और ना ही लोगों को कुछ ओर बताया जो कम से कम इन लोगों को यह तो बता सके कि असल में उनका केस देख कौन रहा है।
जांच दल की मांग:-
1.    गोसिया काॅलोनी के निवासियों को जहां वे लम्बे समय से रह रहे है वहीं वसने दिया जाये तथा डीडीए अथवा किसी अन्य ऐसेन्सी जिसके इशारे पर डीडीए नाच रही है (जैसे कि खसरा नम्बर 1151/3 का मामला) द्वारा जबरन भूमि अधिग्रहण तुरन्त बंद किया जाये। सरकार द्वारा पीडितों को मुवायजा दिया जाये जिससे वे अपना घर पुनः बना सके।
2.    काॅलोनी वासीयों पर विशेषकर महिलाओं पर पुलिस दमन अविलम्भ तुरन्त बंद किया जाए। संघर्ष के दौरान तथा नुरी मस्जिद मामले में भी बनाए गए सभी केसों को तुरन्त वापिस लिया जाये। महिलाओं की पिटाई के दोषी महिला तथा पुरूष पुलिसकर्मीयों के खिलाफ कार्यवाही की जाये।
3.    महरौली और चाणक्यपुरी थाने के थाना अध्यक्ष तथा सम्बन्धित डीसीपी के उपर कमान जिम्मेदारी के तहत कार्यवाही की जाये।
4.    पुरे देश में जनता जबरन भूमि अधिग्रहण लडने को मजबूर है जबकि सरकारें आम लोगों ेस एक इंच भूमि भी छीन लेना चाहती है इस संदर्भ में खसरा नम्बर 1151/3 की कहानी से पूरा षडयंत्र सामने आता है कि किस तरह से यह जमीन खरीदी व बेची गई और वक्फ बोर्ड को कोई परेशानी नहीं हुई। असल में कौन विक्रेता है और कौन खरीदार ? ऐसा लगता है कि पूरे प्रकरण में एक अत्यन्त शक्तिशाली भू-माििफया जिसे महत्वपूर्ण राजनितिज्ञयों तथा पुलिस का पुरा संरक्षण काम कर रहा है। अतः हम मांग करते हैं कि पुरी डील में सुप्रीम कोर्ट के मौजूदा न्यायधीश द्वारा समयबद्ध जांच कराई जाए तथा इस पुरे अमूल्य कीमती तथा ऐतिहासिक भूमि को अधिग्रहीत करने के मामले में पुरा गठजोड है।

        INVESTIGATION REPORT OF PMS TEAM INTO THE DEMOLITION OF HOMES OF 1100 FAMILIES LIVING IN GOSIA COLONY, THEIR HOMELESSNESS AND THE BRUTAL POLICE REPRESSION ON THEIR SUBSEQUENT STRUGGLE. 

 

*   On the night of 9th May 2013, at about 12 midnight, some PMS leaders were informed by some women that around 50 of them were being held at Chanakyapuri Police Station and that they were also accompanied by their tiny children. The information said that the police was misbehaving with them. PMS Gen. Secretary immediately rang up SHO Chanakyapuri and he informed that 16 women were produced before the court after charges under 188 IPC were framed against them, and 40 other women were being released on personal bonds, the filling of which had taken time and hence they were being released at such a late hour. He did not clearly answer who the women were and only said they were arrested while demonstrating. On 10th May 2013 at 11.45 p.m. again the women rang up and said that police were misbehaving with them because they were trying to meet Ahmed Patel (political advisor to Sonia Gandhi). We spoke to SHO Chanakyapuri and he denied the same, saying the women were near Karbala and that they demonstrated every night. The next night (11th May) one injured woman rang up PMS Gen. Secretary at 12 mid night and said that the police have detained 50 women at eleven Murti and men and women police (in which women police were less) have together beaten the women and abused them. She also said one woman’s finger was broken in the police action. PMS Gen. Secretary lodged compliant at 100 number and then spoke on phone to DCP Shri S.B.S. Tyagi. He said that these women are “Bhade Ki’ (Rented women). They violate Supreme Court orders daily and try to demonstrate at the house of Ahmed Patel. When asked why does police not allow the women to meet Mr. Patel he said we cannot do anything in this matter.

 

        Seeing the repressive attitude of the police, curious to know about the reasons for the nightly demonstration and why this police repression is being unleashed against the women, PMS decided to visit the women and enquire into the entire incident.

 

        When the PMS Tema visited Gosia Colony near Andheri Modh at 4 p.m. on 14.05.2013, we found that around 500 families (all muslims) were living under plastic sheets and in makeshift structures there. The local women told us that till 05.12.2012 around 1100 families were residing here in pucca houses spread over Khasra No.217 and Khasra NO.1151/3 and that on that day their houses were brought down by DDA Bulldozers without prior notice. Many Mazars lie in the area alongwith  several masjid. Many Mazar were harmed. The newly built boundary of Gosia Masjid, a new doorway, clearly show that the Masjid was recently broken and then quickly rebuilt. The old entrance door was lying on one side on the Masjid and the Wazohkhana is also demolished.        

 

        The women residents of the area showed us what they said were receipts issued by the Waqf Board a few years back and also showed us Voter ID Cards of the same area some as old as 1996. Some women said their relatives were  working in Dubai and that they were issued passports on the address of Gosia Colony. The residents told us that on 05.12.2012 demolition was carried out without notice by DDA on both the khasras. Despite the cold weather subsequently, despite rains and intense heat, children, women and old are living under plastic sheets. At least 10 residents have died of intense cold they claim. The people have no place to relieve themselves. Women and girls face the most problem in this context. They face eve teasing, vile comments while going to the adjacent DDA Park to relieve themselves. Since the past 2-3 days, police is surrounding the area, prevents the women from going for demonstration at night and when they try to leave the area even in the day time for hospital or for other personal work, forces them to remove their burkhas so as to ‘identify them’. Students’ face academic harm; when their houses were broken, the people were not even given time to remove their belongings, because of which the students were not able to salvage their books and school bags.

 

        After their homes were broken, the people held a dharna against Shri Kamal Nath (Minster for Urban Development) as DDA had carried out the demolition. People says Wakf Board Chairman came to the area and threatened the people to leave the area. After repeatedly sitting on Dharna, on 26.02.2013 the residents met Ms. Sonia Gandhi, at 6 p.m. at 24, Akbar Road. Apart from several local residents, Shri Mehmood Pracha, (Lawyer), Abbas Naqvi (Secretary Wakf Karbala) and some Imams were present. According to the local women residents whom we met, Sonia Gandhi asked her political advisor, Shri Ahmed Patel, who were present in the same room, to enquire into the matter and give her a report.

 

        Shri Ahmed Patel, say the women, promised the delegation that he would soon enquire into the matter. The residents waited for the report for over one month. In between, on 26.04.2013 police entered Noori Masjid and caught hold of people offering Namaz. Women around the Masjid were pulled around by their hair. Cases were lodged against 7 people at the local Mehrauli Thana in which two women were also named. 6 Men are still in Tihar Jail. Women residents say the attempt is to destroy Noori Masjid and also all old structures in the area to wipe out proof of the existence of old structures so that the land can be captured by the land mafia in league with politicians, police and Wakf Board.

 

        After the 26.04.2013 incident, the residents held daily dharnas for one week from 12 Noon to 5 p.m. outside 23 Number House in Chankayapuri (residence of Shri Ahmed Patel). The security at the gate remained evasive about Shri Patel’s availability, and police said he was not present in the house. According to one of the residents, it happened once that just after the police said this, Shri Patel left his house is a car right before their eyes. Officials at the residence / office then told the people on dharna that Shri Patel was only available after 10 p.m. at his residence. The people told us that after this the women decided to go at night to meet him. However, Mr. Patel has not met them till date and though they have spent the last month  going every night to try to meet him, the police does not let them get near his residence, does not even agree to take a delegation to him and instead, knowing the women to be poor and resourceless and without backing of powerful people, lets loose repression on them, which has now increased in intensity. Mr. Patel cannot be unaware of these incidents, but he has never made an attempt to approach these people or call their delegation. If he has already given his report, he can at least inform the protestors.

 

        Thus, for the past several nights and every night, when these women (around 40-50, mostly by turns) reach the area around Mr. Patel’s residence, it is the Chanakyapuri Police which meets them. They were kept in Chanakaypuri Police Station for the entire night on 8th May 2013 and on 9th May 2013, 16 women were produced in the court. The women said that their small children were torn from their arms by the police to force the mothers to sign some papers, and to force them to promise not to tell the judge that the police had beaten them up. The lady police broke the bangles of these women and scratched them – this team was shown the signs of scratches and injuries. The lady police squeezed the breasts of the women. The male police shouted filthy abuses at the women, insulted them and, according to the women, threatened them saying this time we got you to remove your jewellery, next time we will make you take off your clothes. The women were again beaten up on 12th May 2013 night and three women injured. On 16th May 2013, two women and one man from one family were picked up by Mehrauli Police and had not returned till night; another woman going for a job interview was stopped by the police and had not reached home till night. The women say they are kept in other police station and asked to agree to leave the Gosia Colony Area.

 

        After our talks with the residents, seeing the documents they showed and also seeing the area, the PMS Team makes the following comments.

 

1.  The entire area is a heritage area.

 

2.  The historicity of the area is under threat from all types of land sharks including those in government and Wakf Garb. The Gosia Colony lay spread over Khasra Number 217 and Khasra Number 1151/3. The first Khasra was apparently acquired by the DDA in 1974 by a court award. The other Khasra is said to have been wakf land. A sale deed shown to us shows that in the year 2009 Khasra No.1151/3 was sold by one Shabnam Khan of Aulia Masjid Mehrauli to two women, Baby of Kushal Park, Ghaziabad and Farzana of Sri Ram Colony in a purchase worth more than 4 Crore rupees. On 08th October 2009, 8000 sq. yards of land was sold for 4 crores 70 lakhs through official registration. 18 lakhs 8000 rupees were deposited as stamp duty. The seller, Ms. Shabnam, is local resident of this Gosia Colony itself – while all other houses are destroyed, hers has been left untouched.

 

        The area itself merits description. There is a ‘Shams Pond’ few meters from the area to the north and a Burg close by. People say that there was a jungle area towards the south which has now disappeared. Residents claim that the jungle was removed by one Lal Jasdev Raj whose newly built house now stands in the area. Inside Gosia Colony stands Noori Masjid and a Hauj both of which are ancient monuments. In Khasra No.217 there are mazars and Masjid which are part of the gazette notification dated 10.07.1980 of the Govt. of India. (Muslim graveyard with Mosque Dargaha and Hujra in Khasra number No.217).

 

        The team met Mr. Mateen Ahmed, Chairman Delhi Wakf Board on 16.05.2013 afternoon. He said that Khasra No.217 ( where part of  Gosia Colony was situated) was acquired by the DDA by an award in 1974. Wakf Board has approached Shri Kamal Nath, Union Minister for Urban Development for de-notification of this Khasra and the process is almost complete. On the other hand, denying that the current residents of Gosia Colony were tenants of Wakf, he said when the land is not ours how can we make them tenants? We can neither allow  them to stay there nor remove them. He denies that the people were issued tenancy receipts and says they are displaying tenant application forms. Regarding Khasra No.1151/3, he says it is Wakf Land. When shown the photocopy of the sale deed he says it is illegal, and anyway till now no one has come to take possession; when they come we will look into the matter.

 

COMMENTS OF THE TEAM :-

 

    It is firstly clear that the struggling women alongwith their families have been definitely staying in Gosia Colony for atleast around two decades (going by date of voter I Cards). The residents claim that they have been staying there for generations and this can be proved by the Wakf Receipts. The land, going by the surrounding grave yards, mazars, masjids, is definitely of historical value. About Khasra No.217 that stands acquired by the DDA- the Govt. has no right to suddenly evict the dwellers and dispossess them and displace the people. Though application on behalf of the residents have been given at LG Office and at Urban Development Ministry, no one seems to be bothered about the right of the people of Gosia Colony. Both the Govt. / DDA and the Wakf seem quite content to see the land vacated.

 

        The situation of Khasra No.1151/3 is really intriguing. There is a sale deed which shows that a local resident has sold the whole Khasra for crores of rupees to two outsiders. All the transactors are women. The land should be of the Wakf, but the Chairman seems unperturbed over the sale. He states that he will look into the matter when some one comes to claim the land. But is the Khasra really of the Wakf is the question, and the identity of the seller is another. When we tried to photograph Shabnam’s house people came out of the house and argued with us and asked us to leave. Who is Shabnam? Why is the Wakf unperturbed about the sale deed?.

 

        It is clear that some big land racket is on, in which the residents of Gosia Colony are irritants wanted by no one and every one involved wants the area to be cleared of them.

 

        People of the Gosia Colony allege that they have been displaced by a land mafia backed by powerful politicians; hence the police repression to stop their struggle and the all around persistent pressure on them to leave the area as many other families have done and settle elsewhere. On the other hand police alleges that the residents are the instrument of  ‘Land Mafia’ but does not identify if. The Wakf Board Chairman agrees that Khasra NO.1151/3 is Wakf Land, but does not mind at all that the DDA has bulldozzed the area. The Central Govt. has done nothing at all for the 1100 families it has suddenly evicted.

 

        Equally strange is the fact that while there have been daily demonstrations at his house for over a month, Mr. Patel has not met any delegation of residents, nor attempted to answer their queries, nor told the people anything which might guide them about who actually is looking  into their case-that is, if anyone is.

 

DEMANDS OF THE TEAM

 

1.  The residents of Gosia Colony should be allowed to continue to live where they have been living for long and forcible land acquisition, whether by DDA (i.e. Central Govt.) or by any other agency at whose behest DDA has acted (as pertains to Khasra No.1151/3), should be stopped forthwith. People should be paid compensation by the Government so that they can rebuild their homes.

 

2.  Police repression of the colony residents, especially on the women, should stop immediately. All the false cases lodged during the struggle and at the Noori Masjid should be withdrawn forthwith. Policemen and policewomen guilty of beating up the women should be proceeded against.

 

3.  There should be action against the SHO of Mehrauli and Chanakyapuri and the DCP concerned (overseeing Chanakyapuri Thana) in view of the command responsibility.

 

4.  In the whole country, people are faced to fight forcible land acquisitions while governments are exerting to snatch every inch of land from common people. In this context lies the intriguing story of Khasra No.1151/3 and how it has been bought and sold without the Wakf experiencing any discomfort. Who is the seller, actually, and who are the buyers? It seems that a powerful land mafia backed by important politicians which have the police at their beck and call is at work. Hence we demand that there should be a time bound enquiry by a sitting judge of the Supreme Court into the entire deal and into the nexus which is acquiring the invaluable, lucrative and historical land of this area.

TWO YARDS OF LAND FOR BURIAL OF BAHDUR SHAH ZAFAR

 

On May 10th 1857, soldiers of the British Indian Army rebelled in Meerut and captured the Cantonment there. A day later the victorious soldiers triumphantly marched into Delhi. Their war was to liberate the country from the rule of British colonialists ruling under the aegis of East India Company. They proclaimed Bahadur Shah Zafar as the leader of their uprising who, though advanced in age, agreed to their urgings. This first pan-India war of independence against colonial rule shook the foundations of British colonial rule in India which was saved by the oppressive traitorous feudal kings and served by usurious mahajans. It was the last act of the independent feudal kings and the advent of Indian peasantry on the national scene. They displayed great bravery, made unprecedented sacrifices, forged unparalleled unity to throw out colonial rule particularly the unity of the people cutting across social divisions, especially between two largest religious communities, Hindus and Muslims, in the then India which united in their common aspirations despite difference in religious persuasions.

1857 and its aftermath has shaped Indian history and society since then and remains relevant to this day. Significance of two aspects stands out in particular. India continues to be happy hunting ground for the imperialist capital of the former colonial powers of the west who dominate the different aspects of the economic life of the country. The Indian rulers, continuing the inglorious tradition of the despised feudal kings who saved the colonial rule in 1857, are serving the interests of imperialist capital, parroting the imperative need for this capital for India’s ‘development’ and designing to increase further the stranglehold of imperialist capital on the country. The policies are being framed not in the interest of the Indian people, but in the interest of foreign and domestic corporate. Indian rulers are gifting the natural resources of the country to the foreign MNCs and Indian compradors at throw away prices. The great feast of loot and plunder is on which is being hailed as a great saga of development by their apologists and beneficiaries even as the lot of the common people continues to worsen. The only economics they know and practice is the economics of neocolonial dependence and exploitation. British colonialists and later different imperialists in league with the rulers subservient to them, are continuing to exploit our rich natural resources, labour power and to control Indian market.

1857 stands out for its attempt to shape the future of the country free of colonial rule and was a revolt against the ruin it brought upon the Indian peasantry and handicraftsmen. The Indian sepoy was a uniformed peasant. The religious distress the Indians complained of was an expression of their real distress at the colonial loot and plunder.

1857 also symbolized the unity of the people of the country against colonial rule cutting across social and religious divisions. This unity was noted even by British statesmen, including the then leader of the opposition, Disraeli. British worked systematically to undermine this unity, propped up intellectuals on all sides to propagate only diversity and no unity, only differences and no similarities, only discord and no harmony, all to suit the interests of a foreign colonial power to make India a jewel in its crown. A whole intellectual breed was brought up not only to serve as the cogs in the wheel of colonial state machinery but also to sing paeans to the colonial rulers. At that time the biggest obstacle perceived by the British was unity of Hindus and Muslims so they paid main attention to turn these two communities into enemies of each other. They patronized intellectuals to propagate that British rule was to the advantage of each one of the communities against the other, who exerted much to confuse the colonial rule with rulers coming from outside which had been so in all parts of the world; who strained much to obfuscate the basic question of loot and plunder of the country to take the booty to foreign land. Recall the concluding part of Bankim Chandra Chatterjee’s “Anand Math” where British rule is proclaimed to be beneficial for Hindus enabling them to get rid of Muslim rule and paving the way for advent of Hindu rule. And he was not alone.

Deepening the divisions among Indian people has been the instrument of state policy of first the colonial rulers and then the rulers to whom the British transferred power in 1947. They have carefully and methodically harnessed these divisions, preserved and defended the oppressive social hierarchy, all to subvert the Indian people’s struggle against robbing of the country and its people by imperialist capital and their compradors utilizing the landlords in the vast rural landscape as their social base. This has been the cornerstone of the policy of Indian rulers in addition to carrot and stick i.e. reforms and repression, sowing illusions by the former and creating helplessness by the latter which could not have enabled them to suppress so many people over so long a period of time. Even today ruling classes force down so many and such blatantly anti-people policies confident in their belief that they would be able to sidetrack these issues by playing on the social and communal divisions, by making people fight over a small piece of a pie thrown by the rulers while they could acquire the whole if they fought for it.

Even while deepening divisions and using them for maintaining their class rule and implementing anti-people and anti-national policies, the ruling classes have propagated and continue to propagate their so-called commitment to secularism. They sing of the virtues of ‘mutual tolerance’ propagating that we should tolerate each other. Now underlying this is an understanding of basic hostility of interests, lack of commonness so they should ‘tolerate’ each other. You tolerate something disagreeable. There is an extrinsic or intrinsic element of compulsion in this underlining the inherent mutual incompatibility. The secularism propagated by the ruling classes, whatever their sincerity in practice, is shaped by the policy of British colonial rulers to keep the communities apart and in mutual hostility so that the rulers can pretend to stand above them and utilize it in their own interests.

This secularism stands opposed to the secularism of common aspirations, shared history, culture and destiny, shared vision of society which is forged in the crucible of common struggle in defense and furtherance of common interests. This secularism is distinct from and opposed to secularism of the fighters of 1857 who fought to reclaim the country from the foreign rulers, who rallied together to fight for common interest, for common goal of freeing the country. The secularism of the fighters of 1857 was positive secularism. The rebelling soldiers, a good majority of them Hindus, insisted and prevailed upon Zafar to lead their uprising.

Bahadur Shah Zafar became the rallying point of this war of Indian people. Bahadur Shah Zafar became the symbol of this people’s uprising at pan-India scale against colonial rule and their attempt to take their destiny into their own hands. He died in colonial captivity in the then Burma (now Myanmar) longing for two yards of land for burial in his homeland. These two yards of land were already arranged in Mehrauli for the purpose. But the British rulers wanted to remove this symbol of the independence of India from public mind as well as public vision. Zafar died in captivity on November 7, 1862.

Not only British colonial rulers, but even the Indian rulers in power since 1947 did not take up the issue of providing two yards of land to Zafar. Probably this was not expected from the rulers who pride themselves for having benefited from the 200 years of colonial rule over the country or who had proclaimed themselves to be citizens of the empire. They limited themselves to paying formal tributes but probably could not tolerate this symbol of common aspirations of Indian people and their war to free the country from colonial yoke. They could not be expected to bring here to India a symbol which they fear in death as much British colonialists feared when he was alive, as he represents all that they are opposed to. They represent subservience to imperialists and division of the people on communal lines.

Leader of that people’s uprising what is popularly called First War of Indian Independence, longed for two yards of land for his burial in his beloved land. The British obviously denied him, and the rulers who came after transfer of power in 1947 continue to do so till now. They formally pay obeisance to 1957 war, but really have done everything to erase its memories. It is for Indian people to raise their voice for providing the two yards of land longed for by Zafar. This voice should be raised loudly enough to reach the rulers. This voice should be raised powerfully enough to force the rulers to listen. Let May 11, the day this war reached Delhi in 1857, be the beginning of this campaign.
